    Mijn vriendin en ik wonen samen maar zijn nog geen fiscaal partner ... mijn vraag is: Wanneer wij fiscaal partner worden door bijv. een huwelijk kan ik dan met terugwerkende kracht mijn negatieve bedrijfsresultaten verrekenen met haar betaalde IB.

    Kan je die carry-back nog van werking laten zijn op de periode dat je geen fiscaal partner was?...

    Het gaat hier om een VOF trouwens!!

    Nee helaas Andries. Dat staat helemaal los van het feit of je een VOF hebt en ook los van het feit of je fiscaal partner bent. Je inkomen is een persoonlijke aangelegenheid.

    Wel kan je eventuele hypotheekaftrek naar de andere partner schuiven, omdat ander het inkomen anders te laag is om nog iets af trekken. Idem dito met de persoonsgebonden aftrek. (voor liefhebbers art 2.17 Wet IB 2001).
