    Ik zag bij een bedrijf de volgende manier van betalingsherinneringen. In hoeverre mag deze werkwijze juridisch omdat normaliter de 1e betalingsherinnering minimaal 14 dagen als betalingstermijn moet hebben zonder extra kosten?

     

    - factuur: betaaltermijn 14 dagen

    - 1e betalingsherinnering: verzoek om binnen 7 dagen te betalen

    - 2e betalingsherinnering: verzoek om binnen 5 dagen te betalen anders incassokosten erboven op

    - aanmaning: verhoogd met incassokosten binnen 14 dagen te betalen

    Een factuur wordt nooit tegelijk aan een consument en onderneming verstuurd. WIK betreft consumenten. ;)

    Voor de betalingsherinneringen wordt geen onderscheid gemaakt tussen B2C of B2B.

    Ik denk van wel als dat B2B overeengekomen is. Onder welke AV heb je afgenomen, ik zou dat goed nalezen.

    Dan gelden B2B m.i. de algemene voorwaarden boven wettelijke bepalingen, maar laten we reacties van specialisten maar afwachten.

     

    Je hebt toch wel een relatie of transactie als je zoveel inzicht hebt? Of, waarom zou je niet op tijd betalen?

    Regelend/wettelijk... tenzij partijen overeenkomen daar van af te wijken

    B2B mag je tegenwoordig direct 40 EUR rekenen. Zelfs als je in je voorwaarden een lager bedrag had staan.

    4 In geval van een handelsovereenkomst als bedoeld in artikel 119a lid 1 of artikel 119b lid 1 bestaat de vergoeding van kosten bedoeld in lid 2 onder c uit ten minste een bedrag van 40 euro. Dit bedrag is zonder aanmaning verschuldigd vanaf de dag volgende op de dag waarop de wettelijke of overeengekomen uiterste dag van betaling is verstreken. Hiervan kan niet ten nadele van de schuldeiser worden afgeweken.
