    Ik heb een vraag inzake de internationale sportpaardenhandel:

    Inkoop in Nederland in de marge (van particulieren) of met 21% BTW en verkoop naar China.

    Is de verkoop dan ook in de marge of tegen 0% wegens export?

    de margeregeling kennen we alleen in de EU. Als de paarden geëxporteerd worden naar China, dan lijkt mij 0% van toepassing.

    De levering van een paard is belast met 0% btw als deze:

    1. geleverd wordt aan een btw-ondernemer in een ander EU-land (intracommunautaire levering, btw verlegd)
    2. geleverd wordt aan een afnemer buiten de EU (uitvoer).

    Dat lijkt mij wel nuttiger om de exporteisen eerst goed door te spitten, buiten Europa is het doorgaans 0 procent BTW.
