    Hi there,

    Ik ben freelancer en heb 2 (langlopende, 3 jaar+) opdrachten en daarnaast nog wat kleine incidentele (qua verhouding tot de grote 2, minder dan 2%).

    Qua jaaromzet ben zit ik al langere tijd te twijfelen om de switch naar een BV te maken.

    Is er een bedrijfsvorm (Bijvoorbeeld BV met Holding) die veiliger is in relatie tot de Wet DBA?

    Nee ... een BV is geen oplossing voor de wet DBA. Ook een DGA van een BV moet aan de criteria voor zelfstandigheid voldoen.

    Daarbij is omzet geen goede indicator voor de keuze BV wel of niet. Dat is winst. Momenteel minstens 90k winst

    De winst is hoog genoeg voor een BV. Maar hoopte 2 vliegen in 1 klap te vangen.

    Maar heb dus niet echt een oplossing voor de wet DBA :(

    Jawel, maar je kunt ook vanuit een BV 'zzp-en' of 'Freelancen'. 'ZZP' of 'Freelance' zijn geen formele rechtsvormen, meestal zijn het eenmanszaken, maar soms ook BV's.

    Nee, een BV beschermt je juridisch/economisch niet direct tegen schijnzelfstandigheid onder de Wet DBA.

    De Wet DBA kijkt namelijk naar de feitelijke arbeidsrelatie, niet naar je rechtsvorm. Het gaat dus om hoe je werkt (gezag, verplicht persoonlijk werk, inbedding in organisatie), niet of je dat via een eenmanszaak of BV doet.

    Leef je leven door te leven.
